TERMS AND CONDITIONS
INTRODUCTION
These Terms and Conditions (“Terms”) govern your use of the Your Courier platform, operated by Our Courier (Pty) Ltd, trading as Your Courier (“Your Courier”, “we”, “us”, or “our”).
By accessing or using our services, you (“Customer”, “User”) agree to be bound by these Terms.
NATURE OF SERVICE
2.1 Your Courier is a technology platform that connects customers with independent third-party drivers (“Drivers”) for delivery services.
2.2 Your Courier does not provide transportation services and does not act as a carrier.
2.3 All Drivers are independent contractors, not employees, partners, or agents of Your Courier.
USER OBLIGATIONS
You agree to:
Provide accurate pickup and delivery information
Ensure that items are properly packaged and ready for transport
Be available or have a representative present at pickup and delivery points
Not request transport of prohibited or illegal items
PROHIBITED ITEMS
The following items may not be transported using the platform:
Illegal goods or substances
Firearms, ammunition, explosives, or weapons
Hazardous or flammable materials
Drugs or controlled substances (unless legally permitted with documentation)
Perishable goods requiring controlled environments (unless explicitly agreed)
Cash, high-value securities, or negotiable instruments
Human remains or biological waste
Any item that violates South African law or transport regulations
Your Courier reserves the right to refuse or cancel any job involving prohibited items.
BOOKINGS AND PRICING
5.1 All pricing provided is an estimate based on distance, item type, and availability.
5.2 Final pricing may vary due to:
Changes in route or distance
Waiting time
Incorrect information provided by the customer
5.3 A booking is only confirmed once a Driver accepts the job.
PAYMENTS
6.1 Payments are processed via secure third-party payment providers.
6.2 Full payment is required upon completion of the job unless otherwise stated.
6.3 Your Courier may hold or delay payments in cases of disputes or suspected fraud.
CANCELLATIONS AND REFUNDS
7.1 Customers may cancel a booking before a Driver is assigned at no charge.
7.2 Once a Driver is assigned and en route, cancellation fees may apply.
7.3 Refunds are granted at the sole discretion of Your Courier, based on circumstances.
7.4 Approved refunds will be processed within 3–5 business days.
DRIVER RESPONSIBILITY
8.1 Drivers are independent contractors responsible for:
Transporting goods safely
Complying with applicable laws and regulations
8.2 Drivers undergo background and verification checks; however, Your Courier does not guarantee driver performance.
LIABILITY
9.1 Your Courier acts solely as a facilitator and is not liable for:
Loss, damage, or theft of goods
Delays in delivery
Actions or omissions of Drivers
9.2 Customers use the platform at their own risk.
9.3 Any claims must be submitted within 24 hours of delivery.
. INSURANCE
10.1 Drivers may carry their own insurance; however, this is not guaranteed by Your Courier.
10.2 Customers are responsible for arranging additional insurance for high-value goods if required.
. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Your Courier’s liability shall be limited to the value of the delivery fee paid, and not the value of the goods transported.
.ACCOUNT AND PLATFORM USE
You agree not to:
Use the platform for unlawful purposes
Interfere with or disrupt the platform
Attempt to bypass payment systems
Your Courier may suspend or terminate access for violations.
. PRIVACY
Your use of the platform is also governed by our Privacy Policy. We collect and process personal data in accordance with applicable laws in South Africa.
. FORCE MAJEURE
Your Courier shall not be liable for delays or failures caused by events beyond our control, including but not limited to:
Weather conditions
Traffic disruptions
Strikes or civil unrest
. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa.
. AMENDMENTS
Your Courier reserves the right to update these Terms at any time. Continued use of the platform constitutes acceptance of any changes.
